The intention behind expanding Fixed Recoverable Costs was to create proportionate and predictable litigation. But as Thompsons highlight, the current banding framework can leave complex intermediate track cases under-resourced relative to the work required — and that ultimately impacts injured people’s ability to secure appropriate representation.
